This webinar will provide a review of occupational safety and health regulatory and legislative changes during the past year and will forecast what is to come depending upon the outcome of the November 2024 elections. The webinar will help participants understand the key elements of several new OSHA and Mine Safety and Health Administration (MSHA) mandatory standards that take effect in 2024 and beyond, to help better anticipate challenges, training requirements, and cost burdens associated with compliance. OSHA civil penalties increased to $161K per citation effective January 2024, and MSHA penalties are now a maximum of $324K, with personal penalties possible against “agents of management” of up to $88K … and MSHA is aggressively aiming enforcement at contractors of all types working at mine sites.
The new federal rules covered will include: OSHA’s 2024 Hazard Communication Standard final rule, OSHA’s “Walkaround Rights” final rule, OSHA’s changes to Electronic Recordkeeping Requirements and the related SST enforcement, and MSHA’s Respirable Crystalline Silica and Surface Mobile Equipment final rules (which apply to contractors as well), and forthcoming changes to Heat Stress Prevention regulations at the federal and state level. The latest semi-annual regulatory agenda will be reviewed to forecast the agencies’ future plans. The session will also review current OSHA enforcement programs, such as the National Emphasis Programs in effect, the Severe Violators Enforcement Program, and the “Instance by Instance” citation policy, which can result in millions of dollars in civil penalties. The speaker will also address FY 2024 appropriations for the US Department of Labor, and prospects for new OSHA reform legislation in 2025.
